Follow the tips, deductions and recorded time
Tip-pool rules depend partly on whether the employer takes a tip credit. Managers generally cannot share employees’ pooled tips. A mandatory service charge is legally different from a voluntary tip. Pennsylvania requirements can be more protective than federal rules.
- Keep tip-out instructions and daily payment reports.
- Compare closing duties with clock-out times.
- Document deductions for shortages, uniforms or walkouts.
Customer-facing work still has boundaries
Unwelcome sexual conduct may raise legal concerns when employment is conditioned on submission or the conduct meets the applicable hostile-environment threshold. Employer responsibility depends on the harasser’s role and the surrounding facts, including notice and the employer’s response.
Save relevant messages and schedules, and write down reports you made. A later cut in shifts deserves context; timing alone does not prove retaliation.
Common questions
What employees ask us
Can an employer require a tip pool?
Some tip pools are lawful. Review who participates, whether a tip credit is used, what employees actually receive and applicable state rules before deciding that a required contribution is improper.
