When the shift record misses the work
An automatic meal deduction is not automatically unlawful. The question is whether a covered, nonexempt employee was genuinely relieved of duty. Patient calls, charting and required handoffs can make the recorded hours different from the work actually performed.
- Compare time punches, meal-correction requests and pay statements.
- Note when interruptions occurred and who knew about them.
- Preserve your own employment records without copying patient information.
Restrictions, leave and returning to work
A lifting restriction or recurring treatment may raise accommodation questions. ADA protection depends on coverage, disability, qualification, essential duties and undue hardship; a requested adjustment is not always required.
FMLA leave has separate employer and employee eligibility requirements. Keep the request, certification correspondence, attendance points and return-to-work instructions together so the sequence is clear.
Common questions
What employees ask us
Does every interrupted lunch create a claim?
No. Review includes what duties continued, whether time was corrected, employer knowledge and the pay rules that apply to your position. Write down specific examples rather than assuming every deduction was improper.
